Welcome to Ahwepa.com (“we”, “us”, “our”). By accessing or using our website and services (the “Site” and “Services”), you agree to these Terms & Conditions. If you do not agree, please do not use the Site or our Services.
1. Definitions
- “Client”, “you” or “your” means a person or entity using our Site or our Services.
- “Services” means any of our offerings including domiciliary homecare services, non-domiciliary homecare services, home modification, supply or maintenance of medical equipment, caregiver training and consultation. Ahwepa
- “Equipment” means any home-medical equipment or supplies provided, rented or maintained by us.
- “Agreement” means these Terms & Conditions together with any service agreements or contracts you may enter into with us.
2. Acceptance of Terms
By using the Site or engaging our Services, you confirm that you are at least 18 years old or are using the Services under the supervision of a parent or legal guardian, and that you have full authority to enter into this Agreement.
3. Modification of Terms
We reserve the right to change or update these Terms at any time. Changes become effective immediately upon posting the updated Terms on our Site. It is your responsibility to check this page periodically. Continued use after changes means you accept the revised Terms.
4. Use of the Website
You agree to use the Site only for lawful, authorised purposes and in compliance with applicable Ghanaian law (and other applicable laws). Specifically you must not:
- Use the Site to impersonate any person or misrepresent your affiliation with anyone.
- Attempt to gain unauthorised access to our systems, or interfere with Site security.
- Use the Site in any way that is unlawful or infringes another’s rights.
- Reproduce, duplicate, copy, sell or exploit any portion of the Site without our express written permission.
5. Our Services
5.1 Home-care Services
We provide domiciliary (round-the-clock) homecare services and non-domiciliary (daytime/night) homecare services to clients in their homes. Ahwepa
Services will be provided in accordance with any written service agreement or schedule you and we agree.
5.2 Equipment Rental, Supply & Maintenance
We supply and maintain home-medical equipment and supplies for personal use by clients in their homes. Ahwepa
We will use reasonable efforts to ensure equipment is safe and operational; however equipment may have limitations or risks — see Section 8 (Disclaimers & Liabilities) below.
5.3 Home Modification
We may provide services to modify a client’s home (such as installing safety features) to enhance comfort and safety. Ahwepa
5.4 Caregiver Training
We provide structured training programmes to family members or other persons to become effective caregivers. Ahwepa
5.5 Consultation
We may provide consultation services relating to care-planning, equipment selection or home modifications.
We reserve the right to refuse, suspend or terminate any Services at our discretion, for example if we believe a Client is not acting in good faith or is in breach of these Terms.
6. Client Obligations
- You agree to provide accurate, current and complete information when using the Site or engaging Services.
- You will follow any instructions provided by us relating to safe use of equipment or care services.
- You will permit our personnel to access your home for the purposes of delivering or maintaining Services, in accordance with agreed schedules.
- You will pay all fees, charges and expenses due under the relevant service agreement in a timely manner.
- You will treat our staff, caregivers, trainers and equipment with respect and will not interfere with or misuse our equipment or engage in abusive conduct.
- If you rent equipment, you will return that equipment in good working order at the end of the rental term, subject to normal wear and tear.
7. Fees, Payment & Cancellation
- Fees for Services and/or Equipment will be set out in a schedule or written agreement between you and us.
- All payments due must be made in the currency and by the method (bank transfer, mobile money, etc.) specified in the agreement.
- If payment is not made when due, we may suspend Services or repossess equipment (where rented).
- Cancellation or modification of services must follow any notice provisions in your agreement (for example, 24 or 48 hours’ notice). We may charge cancellation fees as set out in the agreement.
- Any deposits are non-refundable unless otherwise stated.
8. Disclaimers & Limitation of Liability
8.1 Disclaimers
- The Services and equipment are provided “as is” and “as available”. While we endeavour to provide safe, reliable care and equipment, we do not guarantee perfection or uninterrupted service.
- Use of any equipment or care services involves some risk. You rely on Services at your own risk.
- We do not give medical advice. If you have a medical condition you must consult a qualified healthcare professional. Our caregivers and staff are trained professionals, but they are not a substitute for medical doctors, unless expressly specified.
8.2 Limitation of Liability
To the fullest extent permitted by applicable law:
- We (and our owners, directors, employees, agents) will not be liable for any indirect, incidental, special, punitive or consequential loss or damage (including lost profits, loss of use, or data) arising out of or in connection with your use of our Site, Services or Equipment.
- Our total liability for direct losses arising out of our gross negligence or willful misconduct shall not exceed the total amount you have paid us in the preceding 12 months for the relevant Services.
- Nothing in this clause excludes or limits our liability for death or personal injury caused by our negligence, or for fraud.
9. Intellectual Property
All content on the Site (including text, graphics, logos, images, software) is our property or the property of our licensors and is protected by copyright, trademark and other intellectual property laws. You may not reproduce, distribute, display, modify or create derivative works of any part of the Site without our written permission.
10. Privacy
Our collection and use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Site or Services you accept that we may collect, store and use your personal data in accordance with the Privacy Policy. Ahwepa
11. Third-Party Websites & Links
The Site may contain links to third-party websites. These links are provided for your convenience only — we do not endorse or control those websites and are not responsible for their content or practices. Use such links at your own risk.
12. Termination of Services
We may terminate or suspend your access to the Site or any of our Services at any time and without notice if you breach these Terms, become insolvent, or if we suspect fraudulent or abusive activity. On termination you must immediately cease use of any Equipment, and if applicable return same to us. Termination does not affect sections of these Terms which by their nature continue (such as limitation of liability, indemnity, intellectual property).
13. Indemnification
You agree to indemnify, defend and hold harmless Ahwepa, its affiliates, and their respective officers, directors, employees and agents from and against any and all claims, losses, liabilities, damages, costs and expenses (including legal fees) arising from your breach of these Terms, your use of our Site, your violation of any law or rights of a third party, or your misuse of our Services or Equipment.
14. Governing Law & Jurisdiction
These Terms and your use of our Site and Services will be governed by the laws of the Republic of Ghana. You agree that the courts of Ghana will have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms.
15. Severability
If any provision of these Terms is found invalid, unlawful or unenforceable by a court of competent jurisdiction, that provision will be severed from these Terms and the remaining provisions will remain in full force and effect.
16. Entire Agreement
These Terms together with any service agreement you enter into with us constitute the entire agreement between you and us regarding your use of the Site and our Services, and supersede all prior or contemporaneous communications, agreements or proposals.
